Terms & Conditions

1. General

By using this website or purchasing from Zest & Blessed ("we," "us," "our"), you agree to these Terms & Conditions. We reserve the right to refuse service to anyone for any lawful reason. Purchasers must be 18 years or older or have a parent or guardian's permission.

2. Handmade Products

Our products are handmade. Small variations in color, pattern placement, glitter distribution, lettering, and finish are natural characteristics of handcrafted goods — not defects. The item you receive may differ slightly from photographs shown on this site or social media.

3. Custom & Personalized Orders

• Custom orders begin production only after payment (or agreed deposit) is received.
• For personalized items, you are responsible for the accuracy of all names, dates, verses, and spelling you provide. What you approve is what we make — items produced exactly as approved are not eligible for refund or free rework.
• Where a design proof is provided, production begins after your approval. Changes after approval may incur additional charges.
• Production timelines are estimates, not guarantees. We will communicate delays as soon as we know about them.

4. Digital Products

Digital journals, planners, and printable files are delivered electronically. Due to their nature, all digital product sales are final and non-refundable once the file has been delivered or downloaded. Digital products are licensed for personal use only and may not be resold, shared, or redistributed.

5. Payments & Refunds

• Payment is due at the time of order unless we agree otherwise in writing.
• All sales are final. Custom, personalized, and digital items are not eligible for return or refund.
• Deposits on custom work are non-refundable once production has begun.
• If an item arrives damaged in shipping, contact us within 48 hours of delivery with photos of the item and packaging, and we will work with you on a resolution. Any remedy is at our discretion and may take the form of repair or replacement.

6. Shipping, Pickup & Delivery

• Shipping timelines provided by carriers are estimates; we are not responsible for carrier delays, losses, or damage in transit beyond filing assistance.
• Risk of loss passes to you when the package is accepted by the carrier.
• Local pickup arrangements must be honored within 14 days of notification that an order is ready; after 30 days, unclaimed orders may be forfeited without refund.

7. Product Care

Handmade items require reasonable care. Tumblers are hand-wash only — do not microwave, soak, or place in a dishwasher. Damage caused by misuse, improper care, or normal wear is not covered. Care instructions provided with your item are part of these terms.

8. Intellectual Property

All designs, product photography, site content, and the Zest & Blessed name and branding are our property and may not be copied, reproduced, or used commercially without written permission. Custom designs created for your order remain our intellectual property; you receive the finished item, not the design rights.

9. Limitation of Liability

Our products and website are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, our total liability for any claim arising from a purchase or use of this site is limited to the amount you paid for the item giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. Any claim must be brought within one (1) year of the event giving rise to it. We are not responsible for delays or failures caused by events beyond our reasonable control.

10. Indemnification

You agree to indemnify and hold harmless Zest & Blessed and its owner from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of our products, your violation of these terms, or content you provide for custom orders (including designs, images, or text you do not have rights to use).

11. Waiver of Claims

To the fullest extent permitted by law, you waive any claims against Zest & Blessed beyond the remedies described in these terms.

12. Dispute Resolution & Binding Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action. If a claim is found to be frivolous, the filing party bears the other party's reasonable costs. These terms are governed by the laws of the State of Texas.

13. Privacy

We collect only the information needed to fulfill your order and communicate with you. We never sell your personal information. We share it only as required by law or to complete your order (for example, with a shipping carrier).

14. Miscellaneous

These terms are the entire agreement between us regarding purchases and site use. If any provision is found unenforceable, the remainder stays in effect, and an unenforceable arbitration provision shall be reformed to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You consent to receive communications from us electronically. Sections that by their nature should survive (intellectual property, liability, indemnification, dispute resolution) survive any termination.
